Gair Gallo Eberhard wins new trial for client facing life sentence

On June 26, 2025, Judge Thomas M. Durkin of the U.S. District Court for the Northern District of Illinois ruled in favor of Gair Gallo Eberhard client, Donald Lee, granting him a new trial on the basis of prosecutorial misconduct. In ruling, the Court rejected the government’s argument that Giglio v. United States mandates only the disclosure of binding promises and found that the government had knowingly elicited false testimony from five cooperating witnesses, in violation of Napue v. Illinois.
