U.S. District Judge John W. Darrah today dismissed a case brought against two Nigerian companies and their president, all of whom were represented by GLG.
The plaintiff, who ran an Aurora-based exporter to Nigeria, sued for breach of contract and fraud in connection with a failed deal for the defendants to acquire the company and employ the plaintiff. GLG moved to dismiss based on forum non conveniens, lack of personal jurisdiction and Colorado River abstention. Without reaching the other grounds, Judge Darrah adopted GLG’s forum non conveniens analysis, relying principally on the fact that the assets at issue are in Nigeria and that a U.S. judgment would have to be enforced in a Nigerian court, thus requiring the parties to litigate the same issues in two fora.
